The following eligibility requirements depend on whether your spouse is employed or a student. Each category will need to meet slightly different requirements when you apply.

 

1. Open Work Permit for PGWP Holders’ Spouses
 

PGWP holder spouse extension is determined by the graduate's active employment profile.

  • To qualify for a PGWP holder spouse extension, the main applicant must be actively working or have a written job offer.
  • Their job must be a NOC TEER category 0 (management) or TEER 1 occupation. Some TEER 2 and 3 jobs are eligible if they are on a verified labor market need list; however, NOC level 4 and 5 jobs are not eligible for PGWP spouse extensions.
  • You will need to include a letter from your spouse’s employer detailing their role, wage, and NOC code. You will also need to provide recent pay stubs as proof of their continued employment.

 

 

2. Open Work Permit Extensions for Spouses of Foreign Workers

 

This category applies to spouses of foreign workers with closed permits or LMIA-required work permits. Their visa typically has an admin code of C41.

 

  • The worker must be employed under a TEER 0, 1, or, if they have a TEER 2 or 3 occupation, it must be on the priority LMN list. Some examples of eligible occupations include healthcare, construction, and other STEM positions.
  • The worker must be living in Canada or intend to live in Canada while employed.

 

3. Work Permit Extension for Spouses of International Students

 

The final category is for those married to students on valid study permits. The student’s administrative code will say C42.

 

The student spouse must be studying in a university degree program. Eligible programs include a master’s or a Doctorate (Ph.D.) program that is at least 16 months in length. Some professional undergraduate programs are also eligible, such as Medicine, Dentistry, and Law.

Applying early and with as much information as possible can reduce your chances of delays or a refusal of extending open work permit Canada. Make sure to follow the steps in order:

 

Step 1: Get Your Documents in Order

Have electronic copies of your marriage license or common-law status documentation, your current SOWP, your spouse’s valid work permit, and your spouse’s proof of skilled employment readily available.

Step 4: Submit Payment

As with most applications, there is a fee. You can expect to pay $150 CAD for work permit processing and $100 CAD for open work permit holder fees. If your biometrics have expired or you were not previously required to provide them, you will be required to pay an additional $85 CAD.
