Canadian Immigration Family: Spousal Sponsorship: Family reunification scheme

The family/spousal sponsorship program introduced by the IRCC reunites close ones who live apart. This initiative was taken after world war II, and since then, the Canadian immigration authority has prioritized the applications based on family sponsorship. This program is also useful for the other purposes of improving the economy and spreading an optimistic approach to support humanity. It is the second most categories for which the authority receives requests.

 

What is Family: Spousal Sponsorship Canada?

  • The program allows family members to come and stay in Canada on permanent residence.
  • The program requires individuals to provide basic needs and financial stability to persons going to be sponsored. 

Who can sponsor?

To become eligible for sponsoring your family member, a person must be

  • A Canadian citizen or permanent resident in the country
  • 18 years old or above
  • able to support their dependents financially

Who can be sponsored?

  • Spouses/ Common law partners
  • Dependent children
  • Parents/Grandparents

Sponsorship Agreement

If you are ready to sponsor and have met the eligibility norm, you must also sign a sponsorship agreement with the sponsored member. The agreement signifies that you are willing to pay the sponsored applicant's debts, major financial needs, and other basic requirements. The financial dependency involves the cost of meals, clothes, health, accommodation, and transportation.

Sponsorship Undertaking

The sponsorship program has a locking period that is called sponsorship undertaking. It is a legal period for which the person needs to support their family members. It also requires you to pay social assistance in case the sponsored members need it.

The undertaking is applicable in every case of sponsorship. It can't be withdrawn even if situations alter (i.e., if the individual you are sponsoring gets Canadian citizenship, if you take a divorce or get separated, OR if you are having financial instability).

The length of the undertaking you will be demanded to sign will rely on the family member you are financing and, in the case of kids, their age:

How to apply for Family/Spousal Sponsorship?

Apply to sponsor

  • The sponsor must first download and complete the form in the application package.
  • Sign the document digitally along with the person you are going to sponsor (principal applicant)
  • The applicant will then upload completed forms with the online application.
  • Upon completing the online form, the applicant will sign the entire application.

Apply to be sponsored

The applicant needs to create the Permanent residence online application portal account.

The following forms need to be filled in to continue your PR application under the family sponsorship program.

  • Generic Application Form for Canada (IMM 0008)
  • Schedule A – Background/Declaration (IMM 5669)
  • Additional Family Information (IMM 5406)
  • Supplementary Information - Your travels (IMM 5562)

Submit application fees

The online application is chargeable, and the intended person needs to pay the fees once they finish the application.

The applicant must submit the biometric fees at the time of application submission. The cost includes the charges of gathering fingerprints and your digital photo.

Send additional documents

Once you submit the application and it gets accepted for processing, there might be a case when you are asked to submit additional documents for a medical certificate and police clearance.

Types of Spousal: Common-Law Sponsorship Applications

Inland: The application can be created inside Canada because the person you want to sponsor is in Canada. This kind of sponsorship authorizes applicants to stay in Canada while their permanent residence application is being processed.

Suppose the application is made from within Canada. In that case, the person you are sponsoring may apply for an open work permit that would allow them to work for any employer in Canada while the sponsorship application is being processed.

Spouses or partners can come to Canada by applying for a Temporary Resident Visa (TRV).

Outland: The application is created from abroad through a Canadian Embassy or Consulate.

In this case, the person you are sponsoring who resides abroad will generally wait for permanent residence outside the nation but may visit you in Canada.

 

Dependent Children Sponsorship

You can support your dependent children, whether biological or adopted, to stay with you as permanent residents in Canada.

Children must satisfy the following conditions to be eligible for the program:

  • A child is considered dependent if they are unmarried or in a common-law relationship and are under 22.
  • If a child is over 22, they may be considered dependent if they have a physical or mental disorder that deters them from being able to support themselves.

Sponsor your Parents or Grandparents

The Parent and Grandparent Sponsorship Program (PGP) are two programs that offer Canadian citizens and permanent residents the opportunity to bring their parents and grandparents to stay in Canada.

To be qualified under the Parents and Grandparents Program, you must:

  • Must be a Canadian citizen or permanent resident of Canada
  • Be at least 18 years of age,
  • Be the child or grandchild of the person(s) you are sponsoring,
  • Complete the Minimum Necessary Income (MNI) needed for the size of their family unit and provide Canada Revenue Agency-issued notices of examination as proof
  • Sign a sponsorship contract that acknowledges your commitment to supply the basic needs of the family member(s) for 20 years

Your spouse or common-law partner can assist you in meeting the income requirement by co-signing the undertaking.
